These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Ensomedia, ul. Chorwacka 33/42, 51-107 Wroclaw, Poland ("Ensomedia", "we", "us", or "our"), governing your access to and use of the ShieldWave Pro web security scanning platform and all related services, APIs, and documentation (collectively, the "Service").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
If you do not agree with any part of these Terms, you must not use the Service.

Enterprise accounts may invite team members with different roles and permissions. The account owner is responsible for managing team member access and remains liable for all team member activity.

You bear sole legal responsibility for ensuring you have proper authorization to scan any target. Ensomedia is not responsible for any legal consequences arising from unauthorized scanning. If we receive a complaint about unauthorized scanning, we reserve the right to immediately suspend your account and provide relevant information to law enforcement if required by law.

Current plan features, limitations, and pricing are displayed on our pricing page and may be updated from time to time.
Certain actions consume scan credits. Credit allocation depends on your plan. Credits may reset monthly or carry over depending on your plan terms. We reserve the right to adjust credit pricing and allocation with 30 days' prior notice.
We may offer a free trial period for paid plans. At the end of the trial:

You represent and warrant that:
(a) Authorization — You have legal authorization to scan each domain, URL, and application you submit to ShieldWave. You either own/operate the target or have obtained express written consent from the domain/system owner to conduct security testing.
(b) Permitted Use — You will not use ShieldWave for competitive intelligence gathering, corporate espionage, reconnaissance of competitors' systems, or any purpose not disclosed to the scanned target owner.
(c) No Unauthorized Scanning — You will not scan domains, applications, or systems you do not own or operate without the express written consent of the domain owner. You acknowledge that unauthorized scanning may violate laws in your jurisdiction and the target's jurisdiction (e.g., Computer Fraud and Abuse Act, Computer Misuse Act, Polish Penal Code Art. 267-269b).
(d) Liability — You bear sole legal responsibility for ensuring you have proper authorization. Ensomedia is not responsible for any legal consequences, penalties, or damages arising from unauthorized scanning conducted by you. If we receive credible complaints about unauthorized scanning, we reserve the right to immediately suspend your account, revoke your API keys, and provide relevant evidence to law enforcement if required by applicable law.

ShieldWave Pro uses artificial intelligence to analyze vulnerabilities and generate remediation suggestions. AI-generated content is provided for informational purposes only.
AI-generated remediation suggestions, code fixes, and vulnerability classifications are generated automatically and may contain errors or inaccuracies. You are solely responsible for reviewing, testing, and validating any AI-generated suggestions before implementing them in production environments.
Vulnerability metadata and proof-of-concept data may be transmitted to third-party AI providers for analysis. See our Privacy Policy and Subprocessor List for details.

The Service, including all software, algorithms, scanner engines, user interface designs, documentation, trademarks ("ShieldWave", "ShieldWave Pro"), and proprietary technology, is owned by Ensomedia and protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during your active subscription.
You retain ownership of all data you submit to the Service (target URLs, scan configurations, company information). By using the Service, you grant us a limited license to process this data solely to provide the Service.
Scan reports generated by the Service are your property. You may use, share, and distribute your scan reports as you see fit. We retain a copy of reports for Service delivery purposes only.

We strive to maintain high availability of the Service. However, we do not guarantee uninterrupted or error-free operation. We may experience:
Scan results depend on the target website's availability, configuration, and response. We do not guarantee that our scans will detect all vulnerabilities. ShieldWave Pro is a tool to assist your security efforts, not a replacement for comprehensive security audits by qualified professionals.
We reserve the right to modify, update, or discontinue any features of the Service with reasonable notice. Material changes will be communicated to active subscribers at least 30 days in advance.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF SCAN RESULTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ENSOMEDIA'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO ENSOMEDIA IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
ENSOMEDIA SHALL NOT BE LIABLE FOR:

These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to conflict of law principles.
Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts competent for Wroclaw, Poland.
Before initiating legal proceedings, both parties agree to attempt to resolve disputes amicably through good-faith negotiations for a period of at least 30 days.

These Terms, together with the Privacy Policy, Cookie Policy, and any applicable DPA, constitute the entire agreement between you and Ensomedia regarding the Service.
If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
Failure to enforce any provision of these Terms does not constitute a waiver of that provision.
You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations without restriction.
We shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or internet disruptions.

We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect by:
